Workers' Compensation: $140,000 For Shoulder Injury

August 2010

Ron injured his shoulder while working as a laborer in an industrial plant in Cleveland, North Carolina.  Ron sought our assistance because he was unhappy with his prior attorney.  Simply stated, Ron was dissatisfied with the communication regarding his case.  Many people unfortunately seek help from larger law firms in response to the many television advertisements they see.  However, these firms often provide poor customer service and little real access to experienced attorneys.  This becomes very frustrating to the injured party.

We really had to work to address Ron's medical treatment. We began pushing to get Ron a second opinion, and we eventually succeeded.  This really changed the path of his case.  We were able to obtain additional medical care that greatly benefited our client.

I closely monitored Ron's medical documentation.  In doing so, I discovered improper communication by his nurse case manager.  This is a fairly common issue that I often uncover by carefully monitoring my clients' medical documentation.  While reviewing all these records is very time consuming, I'm able to really protect my clients.  In Ron's case, I identified the problem, and utilized the issue to our advantage to gain leverage in his case.

In Ron's case, we had to strategically minimize some issues that hurt the value of his case.  We addressed this issues ethically and properly.  I carefully devised the appropriate legal strategy to minimize the difficulties with Ron's case, while emphasizing our best arguments.  We were able to negotiate an additional $140,000 recovery for Ron to compensate him for ongoing wage loss under the North Carolina workers' compensation law.
