Workers' Compensation: $177,500 For Shoulder Injury

October 2011

Manuel sustained a shoulder injury while working as a delivery driver in Charlotte, North Carolina.  Given the extent of Manuel's injury and the physical demands of his job, it was immediately apparent this accident jeopardized his ability to return to the same position.  Manuel had approximately 25 years of experience with his employer.  I recognized the serious impact this accident would have on my client, and we worked together to address his concerns.

Manuel unfortunately required several surgeries due to the extent of his injury and complications with his recovery.  We simply worked with Manuel, guiding him through the claim one step at a time.  Manuel was an excellent client.  He worked very hard in his therapy, and he carefully considered the advice of his physicians and attorney.  I continually worked to ensure our client got the ongoing compensation he was owed throughout the claim (correct weekly temporary total disability (TTD), mileage reimbursement, appropriate medical care, etc.).

The major issue in this case was how to address Manuel's future wage loss given the resulting disability from his accident.  I secured very favorable medical evidence from our client's treating physicians to bolster his case.  Manuel and I discussed his case: I explained specifically how the North Carolina workers' compensation law applied to his facts.  We ultimately negotiated a very favorable resolution of the claim for an additional $177,500 of compensation.
