Workers' Compensation: $217,500 Recovery For Orthopedic Injuries

James sustained orthopedic injuries when he fell at work in Locust, North Carolina.  The claim was defended by one of the most aggressive workers' compensation companies in North Carolina.  As such, I fought the Defendants continually over the course of approximately six years to obtain proper medical treatment, weekly benefits (TTD), and other benefits for our client.

The Defendants continually tried to deny James proper medical treatment.  I utilized a variety of legal strategies to address the insurance adjuster's refusal and / or late authorization (payment) for recommended medical treatment.  I addressed the same issues with prescriptions.  I also fought to ensure James had a nurse case manager that followed the proper Industrial Commission rules.  I secured medical opinions from James' physicians that were utilized to obtain proper benefits in his case.  

The Defendants employed ongoing surveillance of my client.  While this tactic is not uncommon, the specific approach in this case was unusual.  I ultimately forced the Defendants to cease surveillance of my client.  

We made sure James received every dime he was entitled.  For instance, we recovered mileage reimbursement for our client, which in this case totaled several thousand dollars due to the length of the claim and extensive medical treatment. 

I ultimately negotiated an additional $217,500 recovery for James.  This settlement also included an additional annuity totaling $805,009 that provides for future medical care and protects James' Medicare status.  This total resolution put James back in a position where he and his family can succeed in the future.  It was so gratifying to help these people; to keep them from being victims of this insurance company.
