Workers' Compensation: $265,000 For Back Injury

April 2010

David sustained a back injury while working as machine operator in Charlotte, North Carolina.  He was referred to our firm by another law firm.  Initially, I worked to address the insurance adjuster's refusal to continue David's weekly benefits (temporary total disability) due to a dispute regarding his ability to return to work.  We eventually secured our client's TTD compensation again.

David was a great client, and I thoroughly enjoyed assisting him.  His case was complicated by two primary factors: (a) David got hurt shortly after being hired.  Simply stated, insurance adjusters often deny / fight medical treatment on claims when someone alleges an injury right after being hired.  (b) David had a prior back injury that required surgery.  Insurance companies often argue pre-existing conditions are the cause of current medical treatment, refusing to pay for necessary medical care.  I prepared the appropriate legal strategy to address these issues.  We ultimately secured the proper medical care for David.

David received the proper compensation (medical treatment, monetary benefits while out of work, mileage reimbursement, etc.) to allow him / his family to recover from the accident.  After two mediations, I finally secured an additional $265,000 recovery for David.  This resolution provided David peace of mind and options for his future.
