DWI: Case Dismissed

Michael was charged with Driving While Impaired in Charlotte, North Carolina as a result of an auto accident.  This case presented a scenario we sometimes encounter with auto accident cases: whether the District Attorney can prove the Defendant was driving the automobile.  In most DWI cases, the primary focus concerns the State's effort to prove the Defendant's "impairment".  In Michael's case, I strategically focused our efforts in exploiting the lack of evidence to establish Michael was operating the vehicle. 

The case was complicated by the fact that several officers conducted an investigation into the accident and resulting DWI charge.  While this factor made my job more difficult, it also posed problems for the District Attorney.  I prepared Michael's case for trial.  I developed a plan that would have our client ready for whatever outcome resulted.  I then forced the District Attorney to establish the case against our client.  

As the case progressed, I was able to expose more weaknesses to the District Attorney.  The State ultimately dismissed Michael's case due to insufficiency of evidence.  This result was a significant victory for our client.  He avoided a DWI conviction, which results in real insurance ramifications.  He saved a lot of money.  Michael also avoided the necessity of complying with a ruling from the Court.   

Christopher Shumate

Mr. Chris Shumate is a native of Gastonia, North Carolina, and worked various jobs while pursuing his undergraduate and Juris Doctor education, including several heavy manual labor and skilled trade positions.
