DWI: Case Dismissed
Melvin was charged with Driving While Impaired and Reckless Driving following an auto accident in Charlotte, North Carolina. The primary complicating factor in this case was the fact that Melvin had four prior DWI convictions. Depending on the date(s) of conviction, prior convictions expose a Defendant to significant active jail time, monetary fines. etc.
I strategically prepared a trial strategy to address the challenges of Melvin's case. We instructed Melvin how to mitigate the challenges he faced. Auto accident cases sometimes lead to delicate legal issues regarding the State's burden of proof in a DWI case. Such was the issue in Melvin's case. I prepared to argue the State's difficulties to establish our client's impairment at trial. I carefully analyzed the officer's notes. I discussed the case with the officer to determine his likely testimony. I adjusted our strategy as needed.
The District Attorney ultimately dismissed Melvin's case. This was a very satisfactory result, particularly given the real exposure for our client.
