DWI: Excellent Result
Ryan was charged with Driving While Impaired, Driving With License Revoked, and Failure To Maintain Lane Control in Charlotte, North Carolina. The challenge with Ryan's case was that he had significant exposure due to his prior criminal history, which included three prior DWI convictions. Ryan faced an absolute mandatory minimum of 120 days active jail upon a conviction. He was facing a possibility of 36 months of imprisonment. Ryan faced a maximum fine of $10,000.
I carefully analyzed Ryan's case. I reviewed documentation from various sources, and interviewed the officer to determine his potential trial testimony. I discussed the case carefully with Ryan, outlining a specific plan to achieve the best possible result. I explained to our client exactly how he needed to proceed to minimize his exposure.
Given the specific facts of his case, Ryan wisely elected to proceed with a plea in this matter. We strategically prepared for this arrangement. The associated charges were dismissed. Ryan received the minimum 120 days of active jail time, with credit for the 44 days he previously served. This was the absolute minimum ruling the Court could have provided. The Court imposed a sentence of 12 to 36 months, and placed our client on 36 months of supervised probation. The Court imposed a $200 fine, which was obviously well below the maximum $10,000 fine. Ryan was ordered to complete 120 days of CAM monitoring and referred to the DWI STEP Court.
Given our client's prior criminal history and the specific's of his case, this was a huge victory for Ryan. This result allowed Ryan an opportunity to move forward with his professional and personal life. I was very pleased to successfully navigate so many obstacles for our client.
