DWI: Excellent Result

May 2016

Richard was charged with Driving While Impaired and Failure To Maintain Lane Control in Charlotte, North Carolina.  Richard initially proceeded with legal counsel of the local Public Defender.  When Richard initially retained me, his case was a mess.  The case was in a bad position procedurally.  Richard did not really understand the evidence in his case or the exposure he was facing with a conviction.  No clear legal strategy was being executed.

I met with Richard and outlined my analysis of his case.  I provided a realistic assessment, and detailed a proper legal strategy to address the various issues he faced.  The evidence in Richard's case was quite unfavorable.  As noted, the procedural stance of his case was problematic.  Upon conviction, he was facing a maximum sentence of 12 months and a minimum 7 days active sentence.

We worked to address the procedural difficulties.  I prepared / amended our legal strategy to achieve the best possible result for Richard.  One primary concern was to maintain his employment.  Richard ultimately chose to enter a favorable plea agreement, and we obtained a very favorable ruling from the Court.  Richard was not required to serve any active time, as the Court allowed our client to instead complete 90 days of SCRAM / CAM monitoring.

Given the challenges of Richard's case, I was extremely pleased with this result.  We significantly minimized the Court's ruling in the face of significant exposure for our client.  We really achieved our primary goal here.
