DWI: Motion To Dismiss Granted
Don was charged in Charlotte, North Carolina with Driving While Impaired, Failure To Maintain Lane Control, and Hit and Run. The investigation of this case was quite difficult. Three officers were involved in the case and needed to testify at trial. However, the State was unable to produce video documentation from any of the officers.
The complexity of the case and the uncertainty of the officers' testimony presented us with some difficulty as we prepared Don's strategy. My approach with any case is to ensure our client is prepared for the worst-case scenario, while working towards the best-case scenario. Simply stated, I make every effort to protect my client's interests. While we prepared for trial, I provided Don the proper legal advice throughout his case.
We obtained Don's license, so he could drive pending the disposition of his charges. We also prepared Don to obtain a favorable ruling from the Court if needed. I made sure Don understood what we were doing, and why were were doing so.
At trial, I presented appropriate motions to dismiss the charges to the Court. The Judge granted a dismissal of all three charges against Don. This was a significant victory for our client. The ruling preserved Don's North Carolina license. He avoided significant court costs / fines, along with requirements to complete treatment and community service.
