Workers' Compensation: $45,000 Recovery For Hand Injury

October 2016

Tim worked as a mechanic for a local auto dealer here in Charlotte, North Carolina.  While performing an alignment, he suffered an injury to his right hand.  A local judge referred Tim to our office due to my reputation as a knowledgeable and effective workers' compensation lawyer.  Tim had two primary concerns during our initial consultation (a) obtaining proper medical care for his injury and (b) the effect of the claim on his employment.  We had a thorough consultation, wherein I explained the workers' compensation system and discussed our strategy to address each of his concerns.  We discussed Tim's concerns, and he chose to allow us to help him.

First, I worked to get Tim the medical care needed to address the injury to his hand.  Ultimately, I successfully convinced the adjuster to transfer care to a new physician which improved the level of care my client received.  Tim had a complex injury.  It required extensive conservative care following surgery.  However, he worked with the physician to achieve the best possible result and I obtained all recommended care.

We worked to maintain a positive relationship with Tim's employer, while simultaneously protecting his rights under the workers' compensation system.  This requires a delicate balance and a lot of effort, but is achievable.  I was able to strategically posture Tim's case quite well for negotiations, which helped achieve a very unusual and favorable result.  We ultimately recovered a substantial lump sum for Tim, while he simultaneously returned to work with the employer with a promotion.
